Nullification
In Just a Thought, March 25th, 2010
Have you heard of the concept of “nullification”?
It is a constitutional concept by which states rein in an overreaching federal government. The concept is rooted in the 10th amendment which reserves to the states all rights not specifically granted the federal government. Using their 10th amendment rights, a state could nullify federal laws the state deemed unconstitutional.
The most famous nullification challenge came when South Carolina refused the authority of DC to impose a tariff that favored the industrial North over the agricultural South. The challenge was ultimately settled by a compromise but not before some tense moments.
Nullification may be coming to a state near you soon. Virginia is leading thirty six states in preparing to nullify any federal law mandating its citizens purchase approved health insurance.
When only 21% of Americans believe Congress is acting with the consent of the governed, expect to hear more about nullification.
Can you spell States’ Rights?
